Terms & Conditions – Kumar Electrical
1. Quote Validity
All quotations are valid for 14 days from the date of issue unless otherwise stated in writing.
Quotations not accepted within this period may be withdrawn or revised by Kumar Electrical. Any revised quotation will be based on current supplier pricing, product availability and site conditions at the time of reissue.
2. Scope of Works
This quotation includes only the works specifically described in the quote.
Any additional work requested by the customer, or made necessary due to unforeseen site conditions, existing defects, or compliance requirements, will be treated as a variation and charged accordingly.
Unless otherwise stated, quotations do not include patching, painting, plastering, or making good of walls, ceilings or other building finishes.
3. Factors Affecting Installation
Quoted installation times and pricing are based on the information available at the time of quoting.
Additional labour or materials may be required due to factors including, but not limited to:
Existing wiring condition.
Restricted roof or ceiling access.
Building construction or concealed services.
Location and suitability of existing electrical equipment.
Previously concealed defects or non-compliant installations.
Changes requested after work has commenced.
Where reasonably practicable, Kumar Electrical will advise the customer of any additional costs before proceeding.
4. Roof Space Access & Electrical Safety
Queensland electrical safety requirements generally require power to be isolated before entering domestic roof spaces.
Where roof access is required, this safety requirement may increase installation time and associated costs.
If roof spaces are unsafe due to heat, vermin, asbestos, inadequate access, stored items or other hazards, Kumar Electrical may postpone or suspend works until safe access can be provided.
5. Compliance with Australian Standards
All electrical work is carried out in accordance with applicable Australian Standards, Queensland legislation and electrical safety requirements.
If existing defects or non-compliant electrical work are identified during the course of the works, Kumar Electrical may be legally required to rectify or isolate the affected installation before it can be safely re-energised.
Any additional work required will be discussed with the customer and treated as a variation unless immediate action is reasonably required to eliminate an electrical safety risk.
Kumar Electrical is not responsible for existing defects or non-compliant electrical work that existed prior to the commencement of the quoted works, except to the extent required by law.
6. Customer-Supplied Products
Kumar Electrical may, at its discretion, install products supplied by the customer.
Where customer-supplied products are installed:
Kumar Electrical provides a 12-month workmanship warranty on the installation only.
Kumar Electrical does not provide any warranty for customer-supplied products, including their quality, suitability, compatibility, performance or manufacturer defects. Any applicable warranty remains solely between the customer and the product manufacturer or supplier.
If a customer-supplied product is found to be faulty or fails after installation, any attendance to inspect, remove, replace or reinstall the product will be charged at Kumar Electrical’s applicable service and labour rates unless the fault is determined to be the result of defective workmanship by Kumar Electrical.
Any additional labour required due to faulty, damaged, incompatible or incomplete customer-supplied products will be charged at the applicable rates.
Kumar Electrical reserves the right to refuse installation of any product that is considered unsafe, non-compliant, damaged or otherwise unsuitable for installation.
7. Customer Responsibilities
The customer must:
Provide safe and reasonable access to the work area.
Ensure children and pets remain clear of the work area.
Advise Kumar Electrical of any known hazards or concealed services.
Ensure another responsible adult is present where required.
Kumar Electrical reserves the right to suspend work if the work area is considered unsafe.
8. Damage & Concealed Services
Reasonable care will be taken when carrying out the works.
Kumar Electrical is not responsible for damage to concealed electrical wiring, plumbing, gas, communications or other services that could not reasonably have been identified before work commenced.
The customer is responsible for advising the location of any known concealed services.
Minor cosmetic damage that is reasonably unavoidable during installation, including small marks around fittings or access points, is not considered defective workmanship.
9. Variations
Any work outside the original quotation, including unforeseen site conditions, customer-requested changes or additional compliance work, will be treated as a variation.
Where reasonably practicable, Kumar Electrical will advise the customer of any additional costs before proceeding.
Variations may be approved verbally, by email, SMS, through the quoting system, or by any other reasonable form of communication. By requesting or authorising additional work, the customer agrees to the applicable additional charges, and the agreed variation forms part of this agreement.
Where immediate action is required to eliminate an electrical safety risk or comply with legislation, Kumar Electrical may complete the minimum work necessary to make the installation safe. Any such work will be charged at the applicable rates.
10. Product Availability & Price Changes
Quotations are based on supplier pricing and product availability at the time of issue.
If a quotation has not been accepted within the 14-day validity period, Kumar Electrical reserves the right to withdraw the quotation and issue a revised quotation based on current supplier pricing, product availability and site conditions.
Accepted quotations remain subject to supplier pricing and product availability until work commences. If supplier pricing increases significantly, specified products become unavailable, or supply chain issues arise before work commences, Kumar Electrical reserves the right to provide an amended quotation or substitute an equivalent product after consultation with the customer.
Once work has commenced, the quoted price will not change unless:
a variation has been agreed by the customer;
additional work is required due to unforeseen site conditions or compliance requirements; or
otherwise permitted under these Terms & Conditions.
11. Deposits & Progress Payments
Kumar Electrical may require a deposit before commencing works or ordering materials.
Deposits become non-refundable once materials have been ordered or costs have been incurred specifically for the project.
For larger projects, progress payments may be required at agreed milestones.
Failure to make progress payments may result in suspension of works.
12. Service Fees, Cancellations & Rescheduling
Attendance at site may incur a service fee, which includes travel time and an initial period of labour.
Service fees may vary depending on whether attendance occurs during normal business hours, after-hours, on weekends, public holidays or for emergency call-outs.
Appointments cancelled or rescheduled with less than 24 hours’ notice may incur the applicable service fee.
If Kumar Electrical attends site and access is unavailable, a service fee may still apply.
If Kumar Electrical is unable to complete the works due to restricted access, the customer’s absence, delays caused by other trades, or circumstances beyond Kumar Electrical’s reasonable control, additional attendance, travel and labour charges may apply.
Where reasonably practicable, any applicable after-hours, weekend, public holiday or emergency call-out rates will be advised to the customer before work commences.
13. Payment Terms
Payment is due within seven (7) days of the invoice date unless otherwise agreed in writing.
For certain works, Kumar Electrical reserves the right to require payment immediately upon completion or prior to energisation or handover where applicable.
Ownership of all materials supplied by Kumar Electrical remains with Kumar Electrical until payment has been received in full.
14. Late Payments
Overdue accounts may incur interest at 10% per annum, calculated daily, where permitted by law.
The customer agrees to reimburse Kumar Electrical for reasonable costs incurred in recovering overdue amounts, including debt recovery and legal costs where applicable.
Kumar Electrical may suspend ongoing works until overdue accounts have been paid.
15. Warranty
Kumar Electrical provides a 12-month workmanship warranty from the date of practical completion.
This warranty covers defects directly attributable to our workmanship.
Products and materials supplied by Kumar Electrical are covered by the applicable manufacturer’s warranty, where available.
Where a product supplied by Kumar Electrical is found to be faulty and is eligible for repair or replacement under the applicable manufacturer’s warranty, labour associated with inspection, removal, replacement or reinstallation may be chargeable unless otherwise required under the Australian Consumer Law or the fault is due to defective workmanship by Kumar Electrical.
This warranty does not apply to:
Normal wear and tear.
Accidental or malicious damage.
Misuse or neglect.
Water ingress, storms, vermin or other external causes.
Alterations, repairs or modifications carried out by persons other than Kumar Electrical.
Existing electrical faults or defects that were outside the original scope of works.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
16. Limitation of Liability
To the maximum extent permitted by law, Kumar Electrical is not liable for any indirect or consequential loss, including loss of income, business interruption or loss of profits, arising out of or in connection with the works.
Kumar Electrical’s liability for any claim arising out of or in connection with the works is limited, at Kumar Electrical’s discretion, to:
re-supplying the services;
rectifying the defective work; or
paying the reasonable cost of having the defective work rectified.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
17. Delays Beyond Our Control
Kumar Electrical is not responsible for delays caused by weather, power outages, supplier shortages, industrial action, natural disasters or other events beyond our reasonable control.
Where such delays occur, installation dates may need to be rescheduled.
18. Photography
Kumar Electrical may take photographs of completed works for quality assurance, compliance records and marketing purposes.
Photographs will not include occupants or identifying personal information without permission.
19. Suspension or Termination of Works
Kumar Electrical reserves the right to suspend or terminate works where reasonably necessary, including unsafe site conditions, lack of access, non-payment, abusive behaviour or other circumstances that prevent the works from being safely or reasonably completed.
The customer remains liable for all work completed, materials supplied and costs incurred up to the date of suspension or termination.
20. Acceptance
By clicking “Accept”, approving this quotation by email or SMS, paying a deposit, requesting Kumar Electrical to commence work, or authorising any variation, the customer acknowledges that they have read, understood and agree to these Terms & Conditions.
These Terms & Conditions form part of every quotation, invoice and agreement issued by Kumar Electrical.
21. Entire Agreement
These Terms & Conditions, together with the accepted quotation and any agreed variations, constitute the entire agreement between Kumar Electrical and the customer in relation to the works.
Any agreed variation, whether approved verbally, by email, SMS, through the quoting system, or by any other reasonable form of communication, forms part of this agreement.
No verbal statements or representations made prior to acceptance of the quotation form part of this agreement unless subsequently accepted or agreed in accordance with these Terms & Conditions.
