Terms & Conditions – Kumar Electrical
1. Quote Validity
All quotes are valid for 14 days from the issue date unless otherwise stated.
2. Factors Affecting Installation
The quoted installation time and costs may be impacted by:
• The condition of existing wiring,
• Ease of access to roof spaces,
• Location and suitability of existing fittings,
• Construction materials of the building.
As of January 1st, 2025, Queensland electrical safety regulations require that all power be isolated before entering domestic roof spaces (unless specific exceptions apply). This may increase installation time and associated costs where roof access is required.
3. Compliance with Australian Standards
To comply with relevant Australian Standards, any defects in the existing electrical system may need to be rectified before the system is re-energised. Kumar Electrical will inform the customer of any variations to the original quote as soon as possible. Kumar Electrical does not accept responsibility for pre-existing defects.
4. Customer Presence During Electrical Work
Customers must remain clear of the work area during electrical works. Electrical work involves live circuits, exposed wiring, and specialised equipment that present serious risks if safety directions are not followed.
Children and pets must be kept away from the work area at all times. Kumar Electrical reserves the right to pause or cease work if the work area is unsafe or safety directions are not followed.
5. Liability for Damage
All reasonable care will be taken during the performance of works. However, Kumar Electrical shall not be liable for damage to concealed services or structures, including but not limited to wiring, plumbing, gas lines, or communication services within walls, ceilings, floors, or underground.
The customer is responsible for identifying the location of any such services prior to commencement of works. Kumar Electrical will not be liable where these were not accurately disclosed or reasonably detectable.
6. Limitation of Liability
To the maximum extent permitted by law, Kumar Electrical shall not be liable for any indirect, incidental, or consequential loss or damage, including but not limited to loss of income, loss of business, loss of use, or inconvenience arising from the works.
Kumar Electrical shall not be liable for minor cosmetic damage resulting from necessary installation works where reasonable care has been taken.
Any liability arising from the works is limited to the value of the services provided under this agreement.
7. Warranty
Kumar Electrical provides a 6-month warranty on workmanship. Materials supplied are subject to the manufacturer’s warranty.
8. Ownership of Materials
All materials supplied remain the property of Kumar Electrical until full payment has been received.
9. Deposit Requirements
A deposit may be required prior to commencement of work. Deposits are used to secure materials and scheduling.
Deposits are non-refundable once materials have been ordered or costs incurred. Prior to this, refunds may be considered at Kumar Electrical’s discretion.
10. Progress Payments
For larger or staged projects, progress payments may be required at agreed milestones. Failure to make payments may result in suspension of works.
11. Revisions and Amendments
Quotes may be amended due to errors, omissions, or material price increases. Any revised pricing will require customer approval.
12. Variations and Additional Work
Any work not included in the original quote, including unforeseen issues, site conditions, or requested changes, will be treated as a variation and charged accordingly.
Where urgent work is required for safety or compliance, Kumar Electrical may proceed without prior approval and charge accordingly.
13. Scope of Works and Exclusions
This quote is based on the information available at the time and includes only the works specified.
Additional work arising from unforeseen conditions, non-compliant installations, or incomplete information will be charged as a variation.
Unless stated, the quote does not include patching, painting, or making good of surfaces.
14. Service Fees, Cancellations and Rescheduling
Kumar Electrical reserves the right to charge a service fee for attendance at site, which includes travel time and an initial period of labour. Service fees may vary depending on the time and day of attendance, including after-hours, weekends, and public holidays.
Cancellations or rescheduling with less than 24 hours’ notice may incur a fee equivalent to the applicable service fee.
If access is not available at the agreed time, the full service fee may still be charged.
Additional time on site beyond the included period will be charged at the applicable hourly rate.
15. Payment Terms
Payment is due within seven (7) days of the invoice date unless otherwise agreed in writing. Kumar Electrical reserves the right to require full payment prior to completion, energisation, or handover of works.
16. Late Payments
Accounts not paid by the due date will be deemed overdue and may incur interest at 10% per annum, calculated daily, until paid in full.
Kumar Electrical reserves the right to suspend or cease work on any project where payments are overdue.
The customer agrees to indemnify Kumar Electrical for all costs incurred in recovering overdue amounts, including administrative fees, debt collection costs, and legal expenses.
Overdue accounts may be referred to a debt collection agency without further notice.
17. Termination of Works
Kumar Electrical reserves the right to suspend or terminate works where reasonably necessary, including but not limited to unsafe site conditions, lack of access, non-payment, or unreasonable or abusive behaviour.
The customer agrees to pay for all works completed, materials supplied, and any costs incurred up to the point of termination. Kumar Electrical is not liable for any delays or damages resulting from termination.
18. Acceptance of Terms
By clicking “Accept”, approving this quote in writing (including email or SMS), or permitting work to commence, the customer acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions in full. These Terms & Conditions are available on our website and form part of this agreement.
